My husband has recently discovered that a judgment has been loaded against his profile without any prior notification from MacRobert Attorneys. This has come as a shock, as he has been actively complying with the payment arrangement since the summons was served in 2024.
To date: • He has paid the agreed monthly instalments consistently, • He has increased the instalments whenever requested, and • We have attached proof of all payments made to demonstrate his compliance. • Unfortunately, during 2019–2023 we experienced a family crisis which temporarily strained our finances and affected our credit profile. However, we have been working diligently to rectify this, and my husband has continued paying his instalments without fail.
It is therefore extremely concerning that a judgment was obtained without any further communication, warning, or notice from MacRobert Attorneys. Furthermore, according to the National Credit Regulator (NCR) guidelines regarding judgment validity: A summons must not have been served more than six months prior to the application for judgment.
Given that the summons was served in 2024, it appears that this requirement has not been met.
We kindly request clarification on the following: 1. On what basis the judgment was granted despite ongoing payments and no communication about non compliance, 2. Why no notice of intention to apply for judgment was issued, and 3. What steps we can take to have this judgment rescinded, as we believe it was granted improperly. 4. We spoke to Mirriam from Macroberts who advised that she has no clue why this happened, so a judgement gets passed on my husband’s record and he can’t apply for employment or anything else. 5. MacRoberts blames ABSA-how can this be accepted- How can ABSA and MacRoberts claim to uphold their values and still treat someone this way, especially when we have been paying the agreed monthly amounts? Yes, we went through a difficult financial period, but we have worked hard to correct the situation. It has been a long and painful struggle, and it is disheartening that this is the outcome. 6. I am sure, ABSA, “ our story matters” 7. Can you live up to your brand and values of courage, stewardship and trust and can Macroberts live up to their values of TRIP-where is the integrity and respect to just pass a judgement on someone and jeopardise someone’s life like this
We would appreciate your urgent assistance, as this matter has severe implications for our financial standing, despite our consistent efforts to meet all obligations.
We look forward to your guidance on the rescission process.
